Privacy Policy

This policy explains what information ProSe CPA collects, how it is used, and who it goes to. ProSe CPA is AI software for preparing and filing your own tax return; it is not a CPA firm, an enrolled agent, or a law firm, and is operated by an individual, not a firm.

Information we collect

Where your information lives

ProSe CPA runs entirely on Amazon Web Services (AWS), in the United States. Documents are stored in an object store (S3) encrypted at rest with a key we control (KMS); your tax profile, account and chat history are stored in a database (DynamoDB) in the same account. Nothing is stored unencrypted, and every connection to our servers uses HTTPS. Access is limited to your own signed-in session; admins can see account, plan and usage information in order to run the service.

How we use it

We use this information to run the service, answer and draft for you, keep accounts secure, respond to your requests, and meet legal obligations. We do not sell personal information, do not share it for advertising, and do not use it to train AI models.

Redaction before the Adviser or chat

Before the Adviser reads a text document or your question, before an answer is stored, and in the Adviser’s engagement memory, full Social Security numbers, taxpayer IDs (ITIN/EIN), and account or card numbers are cut to their last four digits, and birth dates to the year. A PDF or a photograph is sent as it is, unredacted, because the numbers cannot be blacked out without changing the image itself — this is why a PDF or photo you attach should already have anything you do not want an AI system to see removed. This redaction is never applied to the e-file feature, which must transmit your actual return with full identifiers to be accepted by the IRS.

Consent to use your tax return information with AI software (IRC § 7216)

Plain-language summary: to answer a question or draft something for you, the Adviser sends your question and any attached documents to an outside AI service provider under a contract that keeps your data out of that provider’s model training and limits its use to producing your answer. That is a use and disclosure of your tax return information under federal law, and the law (Internal Revenue Code § 7216) requires us to get your affirmative, written consent before we do it — separate from agreeing to these policies generally, and never assumed by using the rest of the app. You give this consent, or decline it, as its own checkbox in the same sheet as the Terms of Service; declining it turns off the Adviser only, not the rest of ProSe CPA, and you can withdraw it at any time by deleting your account.

Formal consent statement [VERIFY against the current text of Rev. Proc. 2013-14 and 26 CFR 301.7216-3 before this consent is relied on for a paid or multi-user launch]: Federal law requires this consent form be provided to you. Unless authorized by law, we cannot disclose your tax return information to third parties for purposes other than the preparation and filing of your tax return without your consent. If you consent to the disclosure of your tax return information, federal law may not protect your tax return information from further use or distribution by the recipient. You are not required to complete this form to engage our services. If we obtain your signature (or affirmative electronic acceptance) on this form by conditioning our services on your consent, your consent will not be valid. Your consent is valid for the period stated in the app (no longer than one year from the date of the consent, renewed on request), unless you otherwise specify or revoke your consent in writing. If you believe your tax return information has been disclosed or used improperly in a manner unauthorized by law or without your permission, you may contact the Treasury Inspector General for Tax Administration (TIGTA) by telephone at 1-800-366-4484, or by email at complaints@tigta.treas.gov.

We do not name the specific AI service provider in member-facing text as a matter of house policy; its identity and the contract terms governing it (no training on your data, confidential handling, deletion on our request) are available to you on request through the app, and to any regulator or auditor who needs them.

Who information goes to

We share information only with the service providers below, only as needed to run the service. We do not sell personal information or share it for advertising.

We may also disclose information if the law requires it (for example, a valid subpoena or court order), or to protect people’s safety or our rights.

Chats and privilege

Questions to the Adviser, its answers, and the documents you attach are not protected by any accountant-client or attorney-client privilege, because no CPA, enrolled agent or attorney is involved. You should assume that anything you type could be requested by the IRS or in a legal proceeding.

Security

Information is encrypted in transit (HTTPS) and encrypted at rest by our cloud provider. No system is perfectly secure. If a breach affects your information, we will notify you as the law requires.

Retention and deletion

Age

You must be 13 or older to use ProSe CPA. If you are 13 to 17, you may use only its free features (no Adviser, no paid plan), and should do so with a parent’s or guardian’s permission. We ask for your birth month and year once, to check your age. For an adult, we keep only that you are an adult, not the month or year. If you are under 18, we keep the month you turn 18 (from which your birth month and year could be worked out), so your limits lift on their own; once you turn 18, we keep only that you are an adult. If someone says they are under 13, or we learn that someone under 13 has an account, we close it and delete their information at once, keeping only a note that the account is closed until an admin reviews it.

Your choices and rights

Some states give additional rights, such as the right to know what information we hold, to access it, to correct it, to delete it, or to opt out of the sale of personal information (which we do not do). Contact us to use any of these rights and we will respond as the law requires.

Changes to this policy

If we change this policy in a way that matters, we will show the change in the app and ask you to agree again before you keep using ProSe CPA.
